1. General conditions

All services provided to the customer by our online shop Mery-Angelo David / meryangelo.com are based exclusively on the following general terms and conditions.

Any other regulations are only valid if they have been individually agreed between meryangelo.com and the customer.

2. Offers

All items offered in this online shop are unique and therefore only temporarily in stock. The articles are decorated or manufactured by hand; the materials are either sustainably produced or come from second-hand markets.

All articles (if not otherwise written) are made by Mery Angelo, from the idea to the production.

Products that are on stock: these represent a non-binding invitation to the customer to order goods in the online shop.

Products upon customer order: These items are manufactured according to the criteria of the customer and are therefore associated with the purchase. The product is paid for in advance.

3. Conclusion of the contract

3.1 Conclusion of a contract for “on stock” products:

By ordering the product, the customer makes a binding offer to conclude a sales contract. The subject of the contract is product ordered by the customer. With regard to the condition, the offer description applies. The order takes place in the following steps:

1) Selection of the product.

2) Confirm by clicking the button "Add to cart" 

3) Checking the information in the cart

4) Press the button "Checkout" 

5) Add your email address and click "Continue" 

6) Add shipping information and click  "Continue" 

7) Connect to your Paypal or pay by Stripe, review and purchase

8) The buyer can cancel the ordering process from the binding submission of the order by pressing the "Back" button in the Internet browser used by the customer

9) You will receive a written confirmation of dispatch with the order details and our terms and conditions by email

3.2 Conclusion of a contract for products upon commission:

 The order is placed through the following steps:

 1) Fill out the availability form at ‘Ask For Availability’

 2) Wait for a confirmation by the artist (happens within 72 hours) - please be aware she can reject your requests.

 3) Receive a confirmation by email and pay a non-refundable deposit of 60 euros. To do this;

Head to Commission Checkout, in our main menu, under the category ‘Commissions us’.

Click on ‘Deposit’ and add to cart.

Follow the steps as stated in 3.1.

 4) If the design is approved, the rest of the price is paid (Full price minus (-) deposit plus (+)  shipping costs. To do this;

Click on the style agreed upon ordering and add to cart.

 5)The artist prepares the goods for delivery and sends the customer the shipment confirmation and the shipment tracking number. For delivery times and costs, see points 6 and 7.

It takes a week for the artist to make a draft of the goods according to the customer's specifications. Communication via email or Whatsapp between artist and customer is very important in this phase.  The creation time takes two to three weeks for the artist to complete the order. Overall time since you fill out the form and receive  the goods is up to two month approximately.

 The goods are manufactured according to the customer's specifications and cannot be returned. The non refundable deposit covers research and draft. The payment, that covers jacket and production cost is not refundable.

Money can only be refunded if the artist disregards the customer's specifications or does not send the goods on time. Delays by the shipping company are not one of these exceptions.

4. Prices

-The prices are in EURO.

-The prices mentioned on the product pages do not include statutory VAT, as meryangelo.com makes use of the small business regulation (no sales tax ID due to the application of the small business regulation according to § 19 UStG).

-Shipping costs are added to the product price in the shopping cart.

5. Instructions on cancellation, right of cancellation           

Consumers generally have a right of withdrawal.

The right of withdrawal does not apply to consumers who do not belong to any member state of the European Union at the time the contract is concluded and whose sole residence and delivery address are outside the European Union at the time the contract is concluded.

The right of revocation does not apply to "contracts for the delivery of goods that are not prefabricated and for whose manufacture an individual selection or determination by the consumer (customer) is decisive or that are clearly tailored to the personal needs of the consumer (customer)". (German Civil Code (BGB) § 312g right of withdrawal).

 -Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier has taken possession of the goods.

In order to exercise your right of withdrawal, you must send a clear declaration to us:

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.

-Consequences of withdrawal

If you withdraw from this contract, we will have given you all the payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment.

We can refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.

-Return

You have to return or hand over the goods immediately within fourteen days from the day on which you inform us about the cancellation of this contract, to:

The deadline is met if you have received the goods.

Submit after the period of fourteen days.

You bear the direct costs of returning the goods.

6. Delivery

Delivery takes place both within Germany and worldwide. Shipping is carried out by DHL with tracking and liability.

Unless otherwise stated in the offer, the delivery time within Germany is a maximum of 3 working days.

The delivery time within Europe is a maximum of 2 weeks, unless otherwise stated in the offer.

The delivery time outside of Europe could vary greatly depending on the delivery location and take up to 3 weeks, and can also be delayed due to restrictions.

If the products are prefabricated, delivery takes place at the latest within two working days (Monday to Friday, excluding public holidays) after placing the payment order via PayPal or after the conclusion of the contract. The customer will be sent the tracking number via email.

If the products are manufactured according to the customer's wishes, the item will be delivered quickly after manufacture. The customer will be sent the tracking number via email.

7. Shipping costs

Shipping success through DHL Germany national and international.

Prices include postage, tracking, liability and packaging.

* If the delivery is to a non-EU country, additional duties, taxes or fees may have to be paid by the customer, but do not inquire with the provider, but with the relevant customs or tax authorities. The customer is advised to ask the customs or tax authorities for details before ordering.

8. Payment

You have the option of paying by PayPal or by Stripe.

-Payment by PayPal: You don't need to have a PayPal account to do it, just register as a guest. 

-Payment by Stripe: you are able to check out using credit cards, debit cards, or Apple Pay. You will need to add your personal information.

9. Property

The delivered goods remain our property until they have been paid for in full (retention of title according to Sections 158, 449 of the German Civil Code). The customer must inform us immediately of any foreclosure measures taken by third parties against the goods subject to retention of title, handing over the documents necessary for an intervention; this also applies to impairments of any other kind. Regardless of this, the customer must inform the third party in advance of the existing rights to the goods.

10. Warranty

If the supplementary performance has been made by way of a replacement delivery, the customer is obliged to return the goods initially delivered to us within 30 days at our expense. The return of the defective goods must take place in accordance with the statutory provisions. We reserve the right to claim damages under the statutory requirements.

11. Liability for defects

If the purchased item is defective, the provisions of statutory liability for defects apply.

The customer is asked to complain to the deliverer about delivered goods with obvious transport damage and to inform the seller of this. If the customer does not comply, this has no effect on his statutory or contractual claims for defects.

12. Copyright

The content and works on these pages created by the website operator are subject to German copyright law. The duplication, processing, distribution and any kind of exploitation outside the limits of copyright law require the written consent of the respective author or creator. Downloads and copies of this website are only permitted for private, non-commercial use. Insofar as the content on this site was not created by the operator, the copyrights of third parties are observed. In particular, contents of third parties are marked as such. Should you nevertheless become aware of a copyright infringement, we would ask you to notify us accordingly. As soon as we become aware of legal violations, we will remove such content immediately.

13. Dispute Resolution

The European Commission provides a platform for online dispute resolution, which you can find at the at the official EU website.

The seller is not obliged and unwilling to participate in a dispute settlement procedure before a consumer arbitration board.

14. Contents and links on our pages

The contents of our pages were created with great care. However, we cannot accept any liability for the correctness, completeness and topicality of the content. As a service provider, we are responsible for our own content on these pages in accordance with general law in accordance with Section 7 (1) of the German Telemedia Act. According to §§ 8 to 10 TMG, as a service provider, we are not obliged to monitor transmitted or stored third-party information or to investigate circumstances that indicate illegal activity. Obligations to remove or block the use of information in accordance with general laws remain unaffected. Liability in this regard is only possible from the point in time at which we become aware of a specific legal violation. 15. Final provisions

The validity of the UN sales law is excluded, German law applies. With an order, the general terms and conditions of the online shop are accepted.

If the customer has no general place of jurisdiction in Germany or in another EU member state, the exclusive place of jurisdiction for all disputes arising from this contract is our place of business.
